Terms of Service

These terms are the agreement between you and LeasEase (Pty) Ltd for the use of our website and mobile app. Please read them. If you do not agree with them, do not use the Platform.

Who we are and what these terms cover

These Terms of Service (the Terms) govern your access to and use of the LeasEase website at leasease.co.za and the LeasEase mobile application. We call both of these the Platform.

The Platform is provided by LeasEase (Pty) Ltd, registration number 2026/353559/07, a private company registered in South Africa. In these Terms we call it LeasEase or we.

By creating an account or using the Platform, you agree to these Terms.

Accounts

  • You must be 18 years or older, and resident in South Africa or in another country where we offer the Platform.
  • Your registration details must be accurate, and you must keep them current.
  • You are responsible for everything done under your account. Tell us straight away if you think someone else is using it.
  • We may ask you to verify your identity before we give you access to certain features.

Acceptable use

You may not use the Platform to:

  • do anything unlawful, fraudulent or harmful;
  • misrepresent your identity, your credentials or your ownership of a property;
  • get around our payment, screening or trust account controls;
  • reverse engineer, scrape or interfere with the Platform or its security;
  • post content that is unlawful, defamatory or discriminatory; or
  • solicit tenants or landlords into off-platform deals in a way that avoids fees or controls.

If you break these rules we may suspend or close your account.

Charges and payment

  • Prices for paid plans are published at leasease.co.za/pricing. We may change them on 30 days' written notice.
  • You can pay by debit order, card or a supported mobile money rail.
  • If a debit order fails, we retry it on the schedule set out in your rent collection schedule.
  • We honour the 30 day money back guarantee on landlord plans, except where rent-protection cover or trust-account services have already been activated.

Rent protection and the trust account

Please note. Neither of the services in this section is live yet. LeasEase does not hold deposits at this time, no money moves through a trust account today, and rent-protection cover cannot yet be taken up.

Rent protection

Rent-protection cover is insurer-backed and, until it launches, it is not yet live. Where you opt into that cover once it is available, the cover, the exclusions and the claims process will be governed by the rent-protection underwriting agreement entered into between you, LeasEase and the licensed insurer.

The trust account

Deposits will be held in a PPRA property-practitioner trust account under a registered principal's Fidelity Fund Certificate, as contemplated in section 54 of the Property Practitioners Act. The account will be held at First National Bank and will be segregated from LeasEase's own money.

Interest on a deposit accrues to the tenant, as set out in section 5(3)(d) of the Rental Housing Act 50 of 1999.

Before any deposit is taken we will publish the terms that govern how a deposit is paid in, held, deducted from and paid out, and we will ask you to accept those terms.

Content and intellectual property

  • You keep ownership of the content you upload. You give LeasEase a worldwide, royalty free licence to host, display and process that content for the purpose of running the Platform.
  • LeasEase keeps all right, title and interest in the Platform, including the software, the design and all intellectual property in it.
  • LeasEase™ is a trade mark of LeasEase (Pty) Ltd. Trade mark applications have been filed. The marks are not yet registered.
  • Anonymised, aggregated data generated by use of the Platform may be used by LeasEase to improve its models and to publish market research such as the Rental Health Index. That data cannot be traced back to a person.

Warranties and liability

  • The Platform is provided on an "as is" and "as available" basis. To the extent the law allows, we disclaim all implied warranties.
  • We are not liable for indirect, special, incidental or consequential loss.
  • Our total liability for direct loss is capped at the greater of the fees you paid in the 12 months before the claim, and R50 000.
  • Nothing in these Terms limits liability for fraud, for gross negligence, or for anything else that cannot be excluded by law.

Consumer Protection Act

Where the Consumer Protection Act 68 of 2008 applies to you, nothing in these Terms is meant to limit a right that the Act says cannot be limited.

In particular, a fixed term agreement may be cancelled under section 14 of that Act on 20 business days' written notice, subject to a reasonable cancellation charge.

Personal information

We process personal information in line with our Privacy Policy, which is written to meet the Protection of Personal Information Act 4 of 2013 (POPIA). Our Information Officer is Darrshan Govender, Chief Executive Officer, reachable at info@leasease.co.za.

Our use of cookies is set out in the Cookie Policy.

Termination

  • You may close your account at any time. Recurring charges stop at the next billing cycle.
  • We may suspend or end your access immediately if you materially breach these Terms or the law. Where it is reasonably practical, we will give you written notice.
  • After termination we keep your data only as long as the law and our retention schedule require. See the Privacy Policy.

Disputes

A dispute goes first to our internal dispute resolution process. Email info@leasease.co.za and set out what went wrong and what you want us to do.

If that does not settle it, the dispute goes to mediation under the AFSA Rules. The South African courts have non-exclusive jurisdiction, and these Terms are governed by the laws of the Republic of South Africa.

Nothing in this clause limits a tenant's or a landlord's right to approach the Rental Housing Tribunal on a rental housing dispute.

Changes to these terms

We may amend these Terms on 30 days' written notice. If you keep using the Platform after the effective date, you accept the amended Terms.
